Requirements and Conditions

Your current weight is less than 100kg.
You have an up-to-date medical condition and/or medical work inspection valid for work at height.
You are NOT under the influence of alcohol or other drugs.
You are NOT taking any type of medication that may jeopardise the training and/or rope access exercises/activities.
You will not carry out any manoeuvre without Vertline's supervision.
In all manoeuvres you must be connected at a minimum of two points.
You are aware that you are not physically or mentally contraindicated to perform any rope access task..
Wearing personal protective equipment implies that you are fully aware of it.
Be over 18 years old at the time of the exam.

Personal Declaration of Medical and Health Condition

Rope access at height or depth is an inherent component of the training and examination. Candidates must therefore be physically fit and unaffected by any medical condition that would prevent them from carrying out the requirements of their training or performing the manoeuvres requested at the time of the exam. Candidates must declare that they have no medical condition or contraindication that could prevent them from working safely. The main contraindications for working and exercising at height include (but are not limited to):

Prescription medication
Alcohol or drug dependence
Diabetes, high or low glycaemia;
High or low blood pressure;
Epilepsy, spasms or periods of unconsciousness, e.g. Fainting;
Vertigo, dizziness or difficulty balancing;
Heart disease or chest pain;
Limited function in a limb;
Musculoskeletal problems, e.g. back pain;
Psychiatric illness;
Acrophobia, or fear of heights;
Deprivation of senses, e.g. blindness, deafness.

If a trainee has any contraindications (from the list above or otherwise), he/she must obtain a Medical Certificate (or medical fitness form) from a doctor in order to provide Vertline with confirmation that his/her condition does not prevent him/her from carrying out the training or other Rope Access exercises or work. The Medical Certificate must clearly identify the individual's details (name, date of birth, address), provide confirmation of their state of health and fitness to perform Rope Access activities, and the name and respective details of the doctor providing this Medical Certificate. By signing this declaration, you warrant and undertake that:

The information provided for this agreement is correct and you therefore trust us;Vertline staff, training instructors, examiners and subcontractors are not medically qualified and if you are in any doubt about your medical condition or health you should seek medical advice from an independent doctor before undertaking any physical activity;
Vertline has the right to exclude any candidate from training or examination if they have concerns about their health, fitness or attitude to safety;
It is to the best of its knowledge and belief that it is in good health and is not aware of any inability to carry out Rope Access activities, and that such activities will not be detrimental to its health, well-being or physical condition or others who may be affected by its acts or omissions.
You must notify Vertline if your health or vulnerability to injury changes and stop Rope Access activities immediately unless you are medically approved to do so by a doctor;
If there is any contraindication or doubt about your medical or physical condition to carry out Rope Access activities, you must provide a Medical Certificate proving this.

Training contract

Between Vertline, with registered office at Avenida Silvério Galrão Nogueira n.º 2, 2640-169 Cheleiros, NIF nº 506 488 446, hereinafter referred to as the FIRST PARTY and the candidate, hereinafter referred to as the SECOND PARTY,
Considering that the FIRST PARTY is the promoter of the training course called Anchor Installation Course.
This training contract is hereby signed and governed by the following clauses:
CLAUSE 1 Purpose of the contract The FIRST PARTY undertakes to provide the SECOND PARTY, who accepts, with a training course called Anchor Installation Course.
CLAUSE 2 Training safety and labour accident insurance

The responsibility for repairing training accidents of the contracting trainee is transferred to the Fidelidade Insurance Company through Policy no. AG82760790.
The Trainee must respect:
1. all safety rules and safeguard the safety of the Employer's other Trainees and third parties;
2. comply with and enforce risk assessment;
3. complying with all of the Employer's operating procedures;
4. all the Employer's internal rules, including the proper use, maintenance and upkeep of all material and equipment belonging to the Employer.

CLAUSE 3 Place and time The training programme referred to in clause 1 shall take place at Vertline's premises, on the dates chosen, from 9 a.m. to 6 p.m., totalling 16 hours of training.
CLAUSE 4 Value, Payment and Returns

The course referred to in clause 1 will be exempt from VAT in accordance with article 9 of the CIVA and:
1. Payment must be made no later than 8 days before the start date of the course, by bank transfer under the conditions established by the first party.
2. Payment will only be accepted once proof of payment has been received by email.
3. Invoices will be issued using the details on the enrolment form, unless otherwise indicated in good time.
In cases of cancellation:
1. up to 8 days before the start of the course, the first party will not refund 20 per cent of the total course fee due to procedural costs. The remaining amount paid by the second party will be refunded by bank transfer;
2. up to 3 days before the start of the course, the first party will not refund 50 per cent of the total cost of the course (including the 20 per cent for procedural costs). The remaining amount paid by the second party will be returned by bank transfer;
3. from two days before the start of the course, the first party will not refund any amount.

CLAUSE 5 Trainee rights The SECOND PARTY has the right to:

Participate in the training course in accordance with the programme, methodologies, processes and work schedule defined by the FIRST PARTY.
Obtain, at the end of the course, a certificate attesting to their participation, provided they have met the certification conditions set out in the course programme.

CLAUSE 6 Duties of the Trainee The SECOND PARTY undertakes to:

Attend the training course with assiduity and punctuality, with the aim of acquiring the theoretical and practical knowledge given to them.
Accept and comply with the guidelines issued by the FIRST PARTY and, in particular, the duties arising from the training contract and the induction programme for the training space.
Treat the promoting and training organisations and their representatives with courtesy.
To be loyal to the promoting and training organisations, in particular by not passing on any information of a confidential or reserved nature that they become aware of during the training course.
Use with care and ensure the proper conservation of equipment and other goods entrusted to them for training purposes.

CLAUSE 7 Attendance and Absence Regime

The Trainee must attend the training centre at the times previously established, and attendance must be recorded in a specific document.
Absences motivated by:
1. Proven illness or accident;
2. Maternity and paternity protection;
3. Death of spouse or relatives, under the terms of the legislation in force;
4. Marriage up to a maximum of 5 working days;
5. Fulfillment of an unavoidable legal duty that does not allow for substitution and for the time strictly necessary for its fulfilment, namely military inspection, court and police;
6. To provide family assistance under the terms of the applicable legislation;
7. Other duly proven cases of force majeure, to be analysed by the Training Team and approved by Vertline's Coordination/Directorate.
For the purposes of awarding a grant or other support, absences will only be considered justified up to a limit of 5% of the total number of training hours.
Absences not provided for in paragraph 2 of this article will be considered unjustified:
1. The practice of 5% of unjustified absences may lead to the termination of the Training Contract;
2. Each unjustified absence results in the corresponding loss of the training grant.
The maximum number of absences, whether justified or unjustified, may not exceed 10 per cent of the total duration of the course.

CLAUSE 8 Penalties Serious or repeated breaches of the SECOND PARTY's duties shall entitle the FIRST PARTY to unilaterally terminate this training contract, and all the SECOND PARTY's rights arising therefrom shall immediately cease.
CLAUSE 9 Duration This contract shall be in force for the duration of the vocational training programme referred to in Clause Two.
CLAUSE 10 Supervening changes - effects

When, for reasons beyond its control and not attributable to it, the FIRST PARTY is unable to fully comply with the planned training program, it may make the necessary adjustments (and must always notify and justify this fact to the trainees).
The alteration of the plan provided for in the previous paragraph does not entitle the trainee to any compensation.

CLAUSE 11 Privacy policy The present document presupposes that all the information described is correct and that the SECOND PARTY agrees that it is available for use in accordance with the Data Protection Act and the FIRST PARTY's Privacy Policy, as well as his/her knowledge and consent that the contracts will only be delivered to the FIRST PARTY.
CLAUSE 12 Image Rights The SECOND PARTY assigns to the FIRST PARTY the rights to his/her image obtained during the training and within the scope of this training contract, thereby authorising that it may be used and reproduced, in whole or in part, in photographs, illustrations, videos, animations, brochures, digital platforms and social networks of the FIRST PARTY, advertising and all material produced for the FIRST PARTY's information and dissemination purposes. This image transfer shall be for an unlimited period of time.
CLAUSE 13 Omissions The interpretation of the provisions of this contract, as well as any omissions, will be settled using Decree-Law no. 242/88 of 7th July and other legislation in force relating to Vocational Training supported by public and/or community funds.
